1. About these terms

These Terms and Conditions (the “Terms”) govern your access to and use of girly-pop.store (the “Site”) and any purchase from Girly Pop Store (“Girly Pop Store,” “we,” “us,” or “our”). By visiting the Site, creating an account, or placing an order, you agree to these Terms and to the policies referred to in them, including our Privacy Policy, Refund Policy, Cancellation Policy, and Delivery Policy.

If you do not agree, please do not use the Site. You must be legally capable of entering into a binding contract in your place of residence. If you use the Site for an organisation, you confirm that you are authorised to bind it.

Nothing in these Terms excludes, restricts, or modifies any right or remedy that cannot lawfully be excluded under applicable consumer law.

2. Store information and changes

We aim to keep product descriptions, images, prices, availability, and other Site content accurate. Colours and appearance may vary because of lighting, photography, production batches, and device displays. Measurements are approximate unless stated otherwise.

We may update the Site, products, prices, promotions, and these Terms at any time. Changes do not affect orders already accepted, except where required by law or agreed with you.

3. Products and availability

Products may be available in limited quantities, supplied by third parties, or shipped from different locations. We may limit quantities, discontinue products, or restrict sales to particular people, regions, or jurisdictions where lawful.

An order confirmation acknowledges that we received your order; it does not necessarily mean that we have accepted it. We accept an order when we confirm fulfilment or dispatch, or otherwise expressly confirm acceptance. We may reject or cancel an order before acceptance because of stock unavailability, suspected fraud, pricing or listing errors, payment failure, delivery restrictions, legal requirements, or other reasonable operational grounds. If we cancel after taking payment, we will arrange a refund in accordance with our Refund Policy.

4. Prices, taxes, and payment

Prices are shown in the currency displayed on the Site. Taxes, shipping charges, duties, and other fees are included only where expressly stated and may be calculated at checkout. Your bank or payment provider may charge currency conversion or other fees that we do not control.

Payments are handled by Shopify and/or independent third-party payment providers. We do not control their systems, approval decisions, security checks, settlement periods, or outages. You agree to provide current, complete, and accurate billing and account information and confirm that you are authorised to use the selected payment method.

5. Delivery

Delivery estimates are estimates rather than guarantees unless applicable law expressly provides otherwise. Our Delivery Policy forms part of these Terms. Risk and title pass as provided by applicable law; nothing in these Terms transfers risk earlier than the law permits.

You are responsible for providing a complete and accurate delivery address and for complying with lawful import requirements. Additional charges caused by an incorrect address, refused delivery, or unclaimed parcel may be deducted from a refund or charged to you where permitted by law.

6. Cancellations, returns, and refunds

Our Cancellation Policy and Refund Policy form part of these Terms. Eligibility depends on the product, its condition, the timing and reason for the request, and applicable law. Certain goods may be excluded from change-of-mind returns where lawful, including personalised, made-to-order, hygiene-sensitive, perishable, digital, gift-card, final-sale, or used goods.

Approved refunds are submitted through the relevant third-party payment provider to the original payment method unless another method is required by law or agreed with you. We aim to process approved refunds within a reasonable time, but processing may take up to 30 calendar days. Your bank, card issuer, or payment provider may need additional time to display the credit after it has been submitted.

7. Acceptable use

You may use the Site only for lawful personal or business purposes consistent with these Terms. You must not:

violate any applicable law or another person’s rights;
submit false, misleading, fraudulent, or malicious information;
introduce malware, scrape or harvest data without permission, bypass security, interfere with the Site, or attempt unauthorised access;
impersonate another person, use a payment method without authority, or place orders for unlawful resale or export; or
copy, reproduce, distribute, or commercially exploit Site content without our written permission, except as permitted by law.

We may suspend or restrict access, cancel affected orders, or report conduct to appropriate authorities where we reasonably believe these Terms have been breached.

8. Intellectual property

The Site and its content—including branding, text, graphics, photographs, designs, logos, icons, videos, and software—are owned by or licensed to Girly Pop Store and are protected by intellectual-property laws. No rights are transferred to you except the limited right to use the Site for its intended purpose.

If you submit a review, photo, suggestion, or other content, you confirm that you have the necessary rights and grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt, publish, and display it for operating and promoting the store, subject to applicable law and our Privacy Policy. You remain responsible for your content and must not submit unlawful, infringing, deceptive, or harmful material.

9. Third-party services and links

The Site may rely on or link to Shopify, payment processors, delivery carriers, analytics providers, social networks, and other third parties. Their services and terms are separate from ours. To the maximum extent permitted by law, we are not responsible for third-party acts, omissions, content, availability, delays, security incidents, or decisions that are outside our reasonable control. This does not limit any responsibility we have by law for the way we select or use service providers.

10. Disclaimer

To the maximum extent permitted by law, the Site and its content are provided on an “as available” basis. We do not promise that the Site will always be uninterrupted, error-free, secure, or suitable for every purpose. Product information is general information and is not medical, professional, or other specialist advice.

Any warranties, guarantees, conditions, or terms implied by law are excluded only to the extent the law allows. Where a liability cannot be excluded but can be limited, our liability is limited to the remedies or amount permitted by applicable law.

11. Limitation of liability

To the maximum extent permitted by law, Girly Pop Store and its owners, personnel, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, opportunity, data, or goodwill arising from the Site, an order, a product, or a third-party service.

Where liability may lawfully be limited, our total aggregate liability arising from a specific order will not exceed the amount you paid us for that order. These limits do not apply to fraud, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, or any non-waivable statutory liability.

12. Indemnity

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Girly Pop Store and its owners, affiliates, personnel, contractors, licensors, and service providers from claims, liabilities, losses, damages, penalties, judgments, and reasonable legal costs arising from or related to:

your unlawful use or misuse of the Site or products;
your breach of these Terms;
your fraud, wilful misconduct, negligence, or infringement of another person’s rights; or
content or information you submit.

This indemnity applies only to the extent the claim was caused by your conduct. It does not require you to indemnify us for our own fraud, wilful misconduct, negligence, breach of law, or other liability that cannot lawfully be excluded. We may control the defence of an indemnified claim, and you agree to provide reasonable cooperation. You may not settle a claim in a way that admits liability for us or imposes obligations on us without our written consent.

13. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including carrier disruption, customs delays, natural disasters, severe weather, labour disputes, epidemics, war, civil unrest, government action, power or telecommunications failures, cyber incidents, or supplier interruption. We will take reasonable steps to reduce the impact and perform our obligations when reasonably possible.

14. Governing law and disputes

These Terms are governed by the laws applicable to the operator of Girly Pop Store, without depriving you of mandatory consumer protections in your country or region. Before starting formal proceedings, please contact us through the contact details published on the Site so we can try to resolve the issue in good faith. You retain any right to approach a consumer regulator, ombud, court, or dispute-resolution body that applicable law makes available to you.

15. General

If any provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. Our failure to enforce a provision is not a waiver. We may assign these Terms as part of a lawful business transfer; you may not assign your rights or obligations without our consent except where law permits. These Terms and the policies incorporated into them form the agreement between you and us regarding the Site and purchases.
